Ya know, there's no fight here.Whomever is the named beneficiary on the policy, gets the money. You're going to lose this.Even if she "signed away all rights", that is NOT binding on HIS life insurance policy, which is a contract in and of itself. You need a civil trial lawyer, and you're going to have to pay him up front – probably $5,000 to start, $250 an hour is the going rate. Because you're going to lose this.Sorry.

Did your husband designate a beneficiary in writing to his life insurance company? If so, that party gets the money. The insurance company can only pay the benefit to the named beneficiary(ies).It does not become part of his estate unless his estate is the beneficiary.
